1. Introduction and Acceptance
These Terms of Service ("Terms") govern your access to and use of the Turnfolio platform, website located at turnfolio.com, and all related services (collectively, the "Service") operated by Turnfolio ("we," "us," or "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, you must not access or use the Service.
We reserve the right to update or modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date above. Your continued use of the Service after any such modification constitutes your acceptance of the modified Terms.
2. Eligibility
You must be at least eighteen (18) years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. The Service is not directed at children under the age of 18, and we do not knowingly collect personal information from minors.
3. Description of Service
Turnfolio is a damage-claim-evidence workspace designed for short-term-rental hosts. The Service enables hosts to document property condition through baseline and checkout photography, detect potential damage using AI-assisted vision models, organize and generate reimbursement packets, and produce claim narratives for submission to hosting platforms such as Airbnb AirCover, Vrbo, Turo, Booking.com, Getaround, and Waivo.
The Service includes AI-powered features that assist with damage detection, claim narrative generation, and receipt extraction. These features are assistive tools only and do not replace your independent judgment. AI limitations and disclaimers are set forth in Sections 4 and 9 below.
4. No Guarantee of Recovery — Disclaimer of Claim Outcomes
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT THE USE OF TURNFOLIO TO PREPARE, ORGANIZE, GENERATE, OR FILE A DAMAGE CLAIM IN NO WAY CONSTITUTES A GUARANTEE, WARRANTY, OR ASSURANCE OF RECOVERY FROM SAID CLAIM. Turnfolio is a document preparation and evidence organization tool only. We do not adjudicate, decide, or influence the outcome of any claim submitted to any platform or third party.
Specifically:
Turnfolio prepares a reimbursement packet (including PDF exports, ZIP archives, and markdown narratives) that the user may use in connection with a damage claim. The user is solely and exclusively responsible for reviewing, verifying, editing, and approving all output generated by the Service — including AI-generated narratives, damage assessments, and itemized claims — before submitting any claim to any platform or third party.
The Service never auto-submits a claim on your behalf. You, the host, are the sole person who reviews, edits, and submits a claim. All AI-generated content is labeled as a draft and is non-authoritative.
The AI models used by the Service are non-deterministic and may produce errors, omissions, or hallucinations. We make no representation or warranty regarding the accuracy or reliability of any AI-generated output. You are the only authoritative source of facts regarding your claim.
Turnfolio shall have no liability whatsoever for any claim that is denied, reduced, delayed, or otherwise not fully satisfied by the relevant platform or party. Our sole obligation is to provide the software tools described herein; we bear no responsibility for the outcome of any claim you choose to pursue.
5. User Responsibilities
You are responsible for the accuracy and completeness of all data, photographs, item descriptions, costs, depreciation calculations, and other information you supply to the Service.
You are responsible for reviewing all output of the Service — including generated claim text, damage assessments, and export packages — prior to use or submission to any third party. You acknowledge that all AI-generated content is a draft requiring your independent verification.
You are responsible for the security and confidentiality of any iCal URLs you paste into the Service. These URLs are opaque access tokens issued by hosting platforms, and anyone with the URL can read the property's reservation calendar.
You are responsible for ensuring that you have the legal authority to share the personal information of any guests, cleaners, inspectors, or other third parties whose data you input into the Service, and that such sharing complies with all applicable laws.
6. Account Registration and Security
To access the Service, you must register for an account using a valid email address. Authentication is provided via magic link (passwordless) through our authentication provider, Supabase. You are responsible for maintaining the confidentiality of your account access and for all activities conducted under your account.
7. Subscription Plans and Payment
The Service is offered on a subscription basis through three tiers: Starter ($49/month), Growth ($99/month), and Professional ($199/month).
All payments are processed by Stripe, Inc. ("Stripe"), a third-party payment processor. By subscribing to a paid plan, you agree to Stripe's terms of service and privacy policy. We do not directly store your full credit card number or payment credentials; such information is handled by Stripe in accordance with PCI-DSS compliance standards.
We store your Stripe customer ID, subscription ID, subscription status, plan identifier, current period end date, and trial end date (if applicable) for account management purposes. Stripe webhook events (checkout completion, subscription creation, updates, and deletions) are logged for audit and reconciliation purposes.
Subscriptions automatically renew at the end of each billing period unless cancelled prior to the renewal date. You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period.
Refunds are issued at our sole discretion. No refund shall be issued on the basis that a claim prepared using the Service was unsuccessful, denied, or reduced.
8. Intellectual Property
All content, features, and functionality of the Service — including but not limited to software, text, graphics, logos, and the underlying AI models and algorithms (to the extent we own or license them) — are owned by or licensed to Turnfolio and are protected by applicable intellectual property laws.
You retain ownership of all content you upload to the Service, including photographs, receipts, and property descriptions. By uploading content, you grant Turnfolio a limited, non-exclusive, royalty-free license to process, store, and display your content solely for the purpose of providing the Service to you.
9. AI-Generated Content and Third-Party AI Providers
The Service utilizes third-party AI providers to power its damage detection, narrative generation, and receipt scanning features. A detailed description of what data is transmitted to AI providers, when transmission occurs, and how those providers may use your data is set forth in Section 5 (AI Processing and Data Sharing with AI Providers) of our Privacy Policy. By using the AI features, you acknowledge and accept those data flows.
All AI outputs are subject to the disclaimers and limitations of liability set forth in Section 4 above.
10. Walkthrough Links and Anonymous Access
The Service allows hosts to generate time-limited, single-use walkthrough links for cleaners or field inspectors who do not hold a Turnfolio account. These links expire within 48 hours by default (maximum 7 days) and permit the recipient to upload checkout photographs only.
By generating and sharing a walkthrough link, you represent that you have authorization to share the information visible through that link (including property name, unit label, and room checklist) with the intended recipient, and that you have informed the recipient of the data collection that will occur when they upload photos.
11. Prohibited Conduct
You agree not to: (a) use the Service for any unlawful purpose or in violation of any applicable law; (b) submit fraudulent, fabricated, or misleading claims or evidence through the Service; (c) attempt to gain unauthorized access to any portion of the Service or its related systems; (d) interfere with or disrupt the integrity or performance of the Service; (e) reverse engineer, decompile, or disassemble any aspect of the Service; (f) use the Service to harass, threaten, or harm any third party; or (g) upload content that infringes the intellectual property rights of any third party.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TURNFOLIO, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL TURNFOLIO'S TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE AMOUNTS YOU HAVE PAID TO TURNFOLIO IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
WITHOUT LIMITING THE FOREGOING, TURNFOLIO SHALL HAVE NO LIABILITY FOR: (A) THE OUTCOME OF ANY CLAIM YOU PREPARE, SUBMIT, OR PURSUE USING THE SERVICE; (B) ERRORS OR INACCURACIES IN AI-GENERATED CONTENT; (C) DECISIONS MADE BY ANY HOSTING PLATFORM OR THIRD PARTY REGARDING YOUR CLAIM; OR (D) ANY LOSS ARISING FROM YOUR FAILURE TO REVIEW OUTPUT BEFORE SUBMISSION.
13. Indemnification
You agree to indemnify, defend, and hold harmless Turnfolio and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) any claim or dispute between you and a hosting platform, guest, or other third party; (d) your submission of a claim prepared using the Service; or (e) your violation of any applicable law or regulation.
14. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TURNFOLIO DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.
15. Termination
We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Disclaimer of Claim Outcomes, Limitation of Liability, Indemnification, and Governing Law) shall survive.
You may terminate your account at any time by contacting us or through your account settings.
16. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.
17. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall continue in full force and effect.
18. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Turnfolio with respect to your use of the Service and supersede all prior agreements and understandings.
